The NCDRC observed that the developer had committed a deficiency in service by not completing the project within the stipulated time and directed the company to refund the entire amount paid by the homebuyers with interest at the rate of 12% per annum from the date of payment till the date of realization.

The commission also directed the developer to pay a compensation of Rs 5 lakh to each of the homebuyers for the mental agony, harassment, and inconvenience caused to them. The order also stated that the developer would be liable to pay a penalty of Rs 1 lakh per month for each of the homebuyers if the refund was not made within 90 days.
